Submissions will not be confidential and will become the property of Tdooz upon submission to Tdooz. By providing any Submissions, you agree to assign to Tdooz, at no charge, all worldwide rights, title and interest in copyrights and other intellectual property rights to the Submissions. You represent and warrant that any Submission you provide to Tdooz will be complete and accurate. You acknowledge that you are responsible for the Submissions that you provide, and that you, not Tdooz, have full responsibility for the Submissions, including their legality, reliability, appropriateness, originality and copyright. Tdooz does not prescreen or monitor any Submissions as a matter of policy. Except as expressly stated and agreed upon in advance by Tdooz, no confidential relationship shall be established in the event that any user of this website should make any oral, written or electronic communication to Tdooz (such as feedback, questions, comments, suggestions, ideas, etc.). If any Tdooz website requires or requests that such information be provided, and that such information contains personal identifying information (e.g., name, address, phone number), Tdooz shall obtain, use and maintain it in a manner consistent with our Privacy Policy. 11. PRODUCTS AND SERVICES AVAILABILITY
a. PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES LISTED ON THE SITE ARE SUBJECT TO CHANGE WITHOUT NOTICE. The listing, description of, or reference to, a product or service on the website does not imply that the product or service is presently available. If a product or service is listed at an incorrect price due to a typographical error, error in pricing information received from a vendor, or any other reason, we shall have the right to refuse or cancel any order placed or scheduled, or for such product or service at the incorrect price, even if the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, we shall promptly issue a credit to your credit card account in the amount of the charge.
b. Mere reference and/or listing of a product or service on the website does not constitute a guaranteed ability to sell or supply that product or service and does not mean that the product or service is guaranteed to be currently available. Tdooz manages all or portions of the website from Utah, in the United States of America. We in no way imply that the services detailed on the website are available for contract outside designated zip codes in the United States and we are not able to fulfill orders outside of the United States. Tdooz reserves the right to cancel and refund the costumer for any service that is scheduled and paid for through the app, website or otherwise, that Tdooz, in its exclusive discretion, determines they are unwilling or unable to perform, for any reason, and at any time.
12. WARRANTY
a. Tdooz contracts with third party vendors, affiliates, professionals and service providers to perform the services listed for purchase and scheduling on our app and website. Those vendors and service providers are required to carry their own licensing and insurance, operate as independent businesses and are contractually obligated to perform the services in accordance with our vendor agreement. Liability for damages, failure to perform service, re-service, legal claims or any other warranty matter rests solely between you the customer and them. Digs will help facilitate initial customer’s interaction with the third-party vendor, affiliate, professional and/or service providers, but the liability for performing the work or resolving the claim rest solely with the third-party vendor, affiliate, professional and/or service provider.
13. RELEASE AND HOLD HARMLESS
a. You, the customer, shall fully defend, release, indemnify and hold Tdooz, its officers, owners, personnel and employees harmless from any an all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury of any kind whatsoever to person, property or assets (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any warranty claims, acts, omissions, negligence, or willful misconduct on the part of third-party vendors, affiliates, contractors, professionals, employees and service providers who perform services, attempt to perform services or who in any way are present on your property or person, as a result of you scheduling, ordering or contracting services to be rendered through the Tdooz app, website, or in other like manner. This indemnification applies to and includes without limitation, that payment of all penalties, fines, judgments, awards, decrees, attorneys’ fees, and related costs or expenses, and any reimbursements to Tdooz, its officers, owners, personnel and employees for all legal fees, expenses, and costs incurred by it.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND CONDITIONS, THERE ARE NO OTHER OBLIGATIONS, LIABILITIES OR WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND CUSTOMER HEREBY WAIVES AND RELEASES TDOOZ FROM ANY SUCH OBLIGATIONS, LIABILITIES, WARRANTIES.
14. ORDER ACCEPTANCE
a. Your receipt of an electronic or other form of order confirmation signifies your acceptance of the terms of the services ordered and constitutes confirmation of our offer to manage and/or perform the services selected by you on the Tdooz app or website. We reserve the right at any time after receipt of your order to accept or decline your order for any reason or for no reason at all. We reserve the right at any time after receipt of your service order request, without prior notice to you, to utilize alternate service techniques, send different service providers from previous orders or expectations, utilize different products in conjunction with the services provided than with previous orders or expectations, or any other change that does than effect the generally stated intent of the service or drastically effect the quality of the service ordered, at the sole discretion of Tdooz. We may require additional verifications or information before accepting and/or performing any service.
15. SALES TAX
a. We will automatically charge and withhold the applicable sales tax for product orders to be delivered to addresses within Utah. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state. We will not charge sales tax for services rendered, as appropriate per the governing state or federal tax guidelines of the jurisdiction the services are performed within.
16. REGISTRATION AND SECURITY
a. If you wish to purchase any services or products on the Tdooz app or website or use any services on the app or website, you must open an account with us and provide the required information to us. By entering any information on the website, you represent and warrant that 1) you are at least 18 years of age; 2) you are using your actual identity; 3) you have provided only true, accurate, current and complete information; and 4) you will maintain and promptly update the information that you provide to keep it true, accurate, current and complete.
b. Tdooz reserves the right to preemptively or retroactively amend your customer service information to 1) reflect the reality of the services rendered or proposed to be rendered or agreed to be rendered, 2) accurately reflect the fixed reality of your home's specifications. (For example, number of windows, square footage of lot, number of smoke detectors, number of air filters, etc.). You further authorize Tdooz to charge your card on file, and agree to pay, the difference between the service performed and the service ordered, if such a discrepancy arises. This determination will be made at the sole discretion of Tdooz 1) through evaluating or performing services at your request or subscription, 2) through information provided by third-party service providers performing services or evaluating services to be provided, or 3) any other reliable, channel of information as deemed by Tdooz.
c. Additionally, you agree to maintain the strict confidentiality of your account and any passwords issued to you for your use of or access to the website or any portion thereof, and you agree not to allow any other entity to use any username(s) or password(s) that are issued to you. You shall be responsible for all activity that occurs under your account or password. We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations. All information provided to us will be used in accordance with our Privacy Policy. If you wish to cancel a username or password, or if you become aware of any loss, theft or unauthorized use of a username or password, please notify us immediately at info@Tdooz.com. We may delete or change any username or password at any time and for any reason.
17. PAYMENT
a. You are responsible for any payments due for any products or services ordered through your account. Payments will be collected at the time of product purchase or scheduling service. If we do not receive payment from your credit card issuer or its agents, you agree to pay all amounts due to us. You shall also be responsible for any costs of collection for overdue payments. You can cancel your requested service up to 48 hours prior to the service being performed, at which time, the fee paid will become nonrefundable. If you have subscribed to a service that requires a monthly fee and cancel a service 48 hours or sooner before performance of the service or before the service has been paid for in full, your card will be charged for the full amount of the service. (For example: if you pay for pest control as a scheduled bi-monthly service, have the service performed and then cancel the day after the service is performed, you will be additionally charged as though the service was performed as a one-time service)
18. RELATIONSHIP
a. Your use of this website is independent of Tdooz and not as an employee, agent, partner, or joint venture with Tdooz for any purpose. We may, at our discretion, permit our independent sales representatives and/or vendors to access portions of this website.
19. GOVERNING LAW
a. This Agreement and its performance shall be governed by the laws of the State of Utah, United States of America, without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in the State of Utah, United States of America, in all questions and controversies arising out of your use of this website and this Agreement.
20. ASSIGNMENT
a. You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.
21. MODIFICATION
a. Tdooz may at any time modify these Terms and Conditions in our discretion without notice. Your use of this website will be conditioned upon the Terms and Conditions posted on our site at the time of your use. Please be sure to also review our Privacy Policy before proceeding to use our website.
22. ADDITIONAL TERMS

When this Privacy Policy uses the term “Personally Identifiable Information” it refers to information that lets us know the specifics of who you are and can be used to identify, contact or locate you. Your email address will not be shared with any third parties. Instructions for unsubscribing from any newsletters, promotions or non-transactional related emails are included in every email.

Our Contractors: We contract with other companies (credit card processors, shippers, sweepstakes promoters, website developers) to provide certain services to Tdooz to fulfill orders, provide sweepstakes and create our website. 6. EMAIL USE
When you provide us your email address, we may send you emails necessary to process your order or respond to a request. For example, after you place an order at any of our websites you will receive an email confirmation and, in most cases, an email with package tracking information. We limit the information we provide to outside companies with whom we contract to only what they need to carry out their responsibilities. When you make a purchase, request product information or create an account on our website, your transactional information is transmitted in a safe, encrypted format. We maintain the data you provide, along with a record of your purchases, in a secure database.
In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third-party banking institutions, process agents and distribution institutions. They receive the information they need to verify and authorize your credit card transactions and to ship your order. When collecting credit card information for online purchases, we offer secured server transactions that encrypt your information in transit to thwart someone from intercepting it and misusing it.
